Draft policy on registration of unapproved buildings & layouts in Tamil Nadu -  Madras High Court

Declining to lift the blanket stay on registration of buildings and unapproved layouts on agricultural land, water ways and bodies, Madras High Court has directed the Tanilnadu Government to formulate a comprehensive policy in the matter.

The first bench of Acting Chief Justice Mr. Huluvadi G Ramesh and Justice Mr.  R Mahadevan gave the directive, when the batch of writ petitions and Public-Interest Litigations (PILs) pro and against its earlier order came up on Monday.

While passing interim orders on a PIL from Elephant G Rajendran on September 9, 2016., the first bench headed by the then Chief Justice Mr. SK Kaul (since elevated to Supreme Court), had granted a blanket stay on registration of buildings constructed on unapproved lay-outs, agricultural land, water ways and bodies.

Since then, a batch of writ petitions had been filed by realtors and others to vacate the stay. When the matter came up, the bench refused to oblige.
Instead it directed the government to come out with a comprehensive policy which would not affect the people at large with regard to the conversion of agricultural lands into layouts.

Earlier, Additional Advocate-General Mr.  Ayyadurai submitted that the government has proposed to categorise its lands into four (4) divisions 1. Reognised, 2. Unrecognised 3. Wetlands and 4. dry ones.
